REFUND AND CANCELLATION POLICY

This Refund and Cancellation Policy ("Policy") is issued by ASCEND ATHENA PRIVATE LIMITED, a company incorporated under the laws of India, having its registered office at Gurugram, Haryana, India ("Company", "we", "us", or "our").

This Policy governs the purchase, cancellation, and refund terms applicable to subscriptions for the Company's software-as-a-service platform, TheHireHub.AI ("Platform" or "Services").

By accessing, subscribing to, or using the Platform, you ("User", "Customer", or "you") agree to be legally bound by this Policy.

1. DEFINITIONS

For the purposes of this Policy, unless the context otherwise requires:

  • "Subscription" means a time-bound, paid access to the Platform for a specified billing period.
  • "Billing Cycle" means the recurring period (monthly or annually) for which a Subscription fee is charged.
  • "Auto-Renewal" means the automatic renewal of a Subscription at the end of each Billing Cycle unless cancelled by the User prior to renewal.
  • "Fees" means all amounts payable by the User for access to the Platform, exclusive of applicable taxes.
  • "Cancellation" means termination of future renewal of a Subscription and does not include any refund of Fees already paid.

2. NATURE OF SERVICES

  • The Platform is a digitally delivered, subscription-based software service. No physical goods are sold.
  • Access to the Platform is provided immediately upon successful payment and continues for the duration of the applicable Subscription period.

3. SUBSCRIPTION PLANS AND BILLING

  • The Company currently offers monthly and annual Subscription plans. Additional billing structures may be introduced at the Company's discretion.
  • All Subscriptions are billed upfront in full at the beginning of each Billing Cycle.
  • Subscriptions are subject to Auto-Renewal, unless cancelled by the User prior to the renewal date.
  • By purchasing a Subscription, the User expressly authorizes the Company to charge the selected payment method automatically for each renewal.

4. NO REFUND POLICY

4.1 ALL FEES PAID TO THE COMPANY ARE FINAL, NON-CANCELLABLE, AND NON-REFUNDABLE.

4.2 Without limitation, no refunds, credits, or prorated adjustments shall be provided for:

  • Partial use of the Platform
  • Unused Subscription periods
  • Failure to cancel prior to renewal
  • Dissatisfaction with features, performance, outcomes, or results
  • Changes to features, functionality, pricing, or service structure
  • Temporary or intermittent service interruptions

4.3 The User expressly waives any right to claim refunds except where such waiver is prohibited by applicable law.

5. CANCELLATION TERMS

  • Users may cancel their Subscription at any time through their account dashboard or by contacting authorized Company support.
  • Cancellation shall be effective only for future Billing Cycles.
  • Upon cancellation:
    • No further Fees will be charged after the current Billing Cycle; and
    • Access to the Platform will continue until the end of the paid Subscription period.
  • Cancellation does not entitle the User to any refund for the current or prior Billing Cycle.

5A. COMPANY'S RIGHT TO SUSPEND OR TERMINATE FOR CAUSE

5A.1 The Company reserves the right to suspend or terminate a User's access to the Platform, in whole or in part, with or without prior notice, where such action is reasonably required due to:

  • Non-payment of applicable Fees or failure to maintain a valid payment method;
  • Use of the Platform in violation of applicable laws, regulations, or Company policies;
  • Unlawful, fraudulent, discriminatory, or unethical instructions or conduct; or
  • Material non-cooperation, misuse of the Platform, or actions that materially disrupt service delivery or platform integrity.

5A.2 In the event of suspension or termination under this Section:

  • No refunds, credits, or prorated adjustments shall be issued for any Fees already paid; and
  • The Company shall have no obligation to continue providing access beyond the date of suspension or termination.

6. DEMOS AND TRIAL ACCESS

  • The Company may offer product demonstrations at its discretion.
  • Any trial access, if provided:
    • Is free of charge;
    • Is non-refundable; and
    • Does not automatically convert into a paid Subscription unless expressly agreed in writing.

7. SERVICE MODIFICATIONS AND AVAILABILITY

  • The Company reserves the right to modify, suspend, or discontinue any part of the Platform at any time.
  • Temporary downtime, maintenance, updates, or feature changes shall not give rise to any refund, credit, or compensation.

8. PAYMENT DISPUTES AND CHARGEBACKS

  • Users agree to contact the Company directly regarding any billing concerns before initiating a chargeback or payment dispute.
  • Unauthorized or abusive chargebacks may result in:
    • Immediate suspension or termination of the User's account; and
    • Restriction from future access to the Platform.
  • This Policy shall constitute conclusive evidence of the User's acknowledgment of non-refundability in any chargeback proceedings.

9. TAXES

  • All Fees are exclusive of applicable taxes unless expressly stated otherwise.
  • Taxes once paid are non-refundable.

10. GOVERNING LAW AND JURISDICTION

  • This Policy shall be governed by and construed in accordance with the laws of India.
  • The courts located at Delhi, India, shall have exclusive jurisdiction over any disputes arising under this Policy.

11. AMENDMENTS

  • The Company reserves the right to amend this Policy at any time.
  • Updated versions shall be effective upon publication on the Company's website and shall apply prospectively.

12. ACKNOWLEDGMENT

By purchasing a Subscription, the User acknowledges that they have read, understood, and agreed to this Refund and Cancellation Policy and accept that all payments made are non-refundable.
